Terms of Service

1. Acceptance of Terms

By creating an account, downloading the app, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

DitchToxic is a mobile application that allows users to scan consumer product barcodes and ingredient labels to receive safety ratings (A through F) and ingredient-level analysis. The Service covers product categories including cosmetics, food, household cleaners, baby products, pet products, and supplements.

The Service includes barcode scanning, AI-powered ingredient label reading, ingredient safety tagging (Clean, Caution, or Toxic), personalized health alerts, product recall notifications, and community-contributed product data.

3. Disclaimer of Safety Ratings

Our ingredient safety ratings are generated using publicly available data from sources including, but not limited to, the Environmental Working Group (EWG), the U.S. Food and Drug Administration (FDA), the International Agency for Research on Cancer (IARC), the European Chemicals Agency (ECHA), and peer-reviewed scientific literature.

While we strive for accuracy, you acknowledge and agree that:

• Safety ratings are informational summaries, not definitive safety determinations.
• Ingredient databases may contain errors, omissions, or outdated information.
• Individual sensitivities, allergies, and health conditions vary widely and are not fully captured by general safety ratings.
• A product receiving a favorable grade does not guarantee it is safe for your specific situation.
• A product receiving an unfavorable grade does not necessarily mean it is harmful to you specifically.
• Our ratings are not a substitute for professional medical, toxicological, or dermatological advice.

4. Eligibility and Account Terms

You must be at least 13 years old to use the Service. By creating an account, you represent that you are at least 13 years of age.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to provide accurate and complete information when creating your account and to keep that information current.

5. Subscription Terms

5.1 Free Tier

DitchToxic offers a free tier that includes up to 7 product scans per calendar month. Your scan count resets on the first day of each month. Free tier users have access to basic ingredient safety ratings and product grades.

5.2 Premium Subscription

Premium subscriptions unlock unlimited scans, detailed ingredient breakdowns, personalized health alerts, the AI Ingredient Analyzer, product recall notifications, and additional features as they become available.

5.3 Billing and Renewal

Subscriptions are billed through the Apple App Store or Google Play Store. All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and cancel auto-renewal through your device's App Store or Play Store subscription settings.

Pricing is displayed in the app at the time of purchase. We reserve the right to change subscription pricing with reasonable advance notice. Price changes will not affect your current billing period.

5.4 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.

6. Referral Program

DitchToxic may offer a referral program that allows you to earn rewards by inviting others to use the Service. The following terms apply:

• Referral rewards are granted only when a referred user creates a valid account and meets any stated activation requirements.
• Self-referrals, duplicate accounts, and fraudulent referrals are prohibited and will result in forfeiture of rewards.
• We reserve the right to modify, suspend, or terminate the referral program at any time.
• Referral rewards have no cash value and are not transferable.
• We reserve the right to revoke rewards obtained through abuse of the program.

7. Community Submissions

DitchToxic allows users to submit product data, ingredient corrections, product photos, and reviews ("User Content"). By submitting User Content, you:

• Grant ConsultingWhiz LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display your User Content in connection with the Service.
• Represent that you own or have the right to submit the User Content and that it does not violate any third-party rights.
• Acknowledge that User Content may be reviewed, edited, or removed at our discretion.
• Agree not to submit content that is false, misleading, defamatory, obscene, or unlawful.

8. Intellectual Property

The Service, including but not limited to the DitchToxic application, safety rating database, ingredient scoring algorithm, user interface design, branding, logos, and all associated content, is the exclusive property of ConsultingWhiz LLC and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works of the Service or any part thereof without our prior written consent.

"DitchToxic" and the DitchToxic logo are trademarks of ConsultingWhiz LLC. You may not use our trademarks without prior written permission.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use automated tools, bots, or scrapers to access the Service or extract data.
• Interfere with or disrupt the Service or its infrastructure.
• Redistribute, resell, or commercially exploit the Service or its data without authorization.
• Submit false or misleading product data or ingredient information.
• Impersonate another person or entity.
• Circumvent any access restrictions, scan limits, or subscription requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSULTINGWHIZ LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, HEALTH, USE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY DECISIONS YOU MAKE BASED ON SAFETY RATINGS, INGREDIENT ANALYSES, OR ANY OTHER INFORMATION PROVIDED BY THE SERVICE. YOU USE THE SERVICE AND RELY ON ITS INFORMATION AT YOUR OWN RISK.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any safety ratings, ingredient data, or other content provided through the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless ConsultingWhiz LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.

You may terminate your account at any time through the app settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law) shall survive.

14. Modifications to Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ConsultingWhiz LLC regarding the Service and supersede all prior agreements and understandings.
